Conduct
Corporate code of conduct
Code of conduct (hereafter referred as
"Code") was established in order to enhance compliance
management - the foundation for the accompanied
growth so that all members of the organization may grow within the community. Staffs and
employees of EM Tech should fully obey the law and rules of the country in
which the business office is located, ensure a safe working environment, establish and maintain the business
management process in which the stakeholders can be respected, and operate the
corporate ethically.
In this Code the
requirements for all staffs and employees of EM Tech are presented. This code is applied to the
all forms of structures designing, manufacturing, supplying and selling the
parts used for the production of the goods and services. All
employees and members are required to comply with the Code, and also should
require all sub-network of suppliers providing assembly, parts, raw materials
and package to aomply.
Full
responsibility for complying with regulationsis applicable to the
parties, and if corrective action for violations is not conducted within the required due date, the
appropriate sanction may be taken.
The
Code is based on the EICC Code of Conduct, and the global standards and guidelines established bythe agencies such as the ILO and ISO can be used as the
additional information. In addition, due to internal and external change management policies, the Code may be amended.
When there is any conflict between this Code and local regulations,
the higher standards shall prevail.
■ Human Rights and Labor
This Code presents
the level of the standards prevailing in the international community, and should ensure human rights and the dignity of theirworkers. This Code is will be applied to all types
of employees including temporary workers, migrant workers,student workers, etc.
Prohibition
of the forced labor
All workmust be voluntary. Forced workers, workers according to human redemption contract,
involuntary convict workers, trafficked workers should
not be employed. This includesall actions of moving, hiring,
and transferring socially disadvantaged by means of intimidation,extortion, coercion, abduction,
and fraud for the purpose of labor
exploitation. The transfer of ggovernment-issued identification, passports or work permits should not be required as the employment conditionsof workers. Excessive fees for the purpose of employment are not allowed, and the details of
all fees charged to workersshould be open to the workers In addition, working conditions must be
documented and forwarded in a language understood byworkers.
Prohibition of child labor
The employment of child workers is strictly prohibited. "Child" is the employ under 15 years old - the age when compulsory education ends or theemployee with the
highest age among the employees of statutory minimum age for employment in accordance with local laws. If the child workers arefound, the immediate countermeasures
must be taken. The company must immediately stop the employment of the
child workers, and improve the age verification process in the employment
process. If trainee programs are managed,they must comply with local laws and
regulations. Although the company can hire youth workers at the age higher than thestatutory minimum age, workers under the age of 18 should not perform hazardous work in terms
of health and safety.
Compliance
with working hours
Working hours per week must not exceed the maximum time specified in thelocal laws and regulations. Work hoursof one week should
not exceed 60 hours including the overtime hours per week
except for special circumstances such as an emergencyor natural disaster. However, if the statuary allowed working time in the local countryis less than 60 hours weekly, then it is needed to comply withlocal laws and regulations. Workerson duty seven days a week to ensure that at least
one day's absence. At least one day’s holidays should be guaranteed to
the workers among the 7 working days a week.
Wages and benefits
Wages paid toworkers must include items such as the minimum
wage, overtime pay, legally mandated benefits and must be complied with all local laws and regulations. All overtime must be made voluntarilywith the consent of the employer,
and, depending on local laws and
regulations, the overtime working payment higher thannormal wage must be paid. The pay or cut financialrequirements violating local laws as a disciplinary action will not
be accepted. Payment items and criteria of worker’s
ages should be provided in a language understood by workers
through benefit statement or a
written record payroll history, and thecompany's intranet.
Humane
treatment
Sexual harassment, sexual abuse, corporal punishment, mentalor physical coercion, and inhumane treatment, including rough abuse to the workers should not exist have,
and also the threat of such treatment should not be taken. The regulatory policies and procedures for ensuring humane treatment of the workers
should be defined and fully described to the workers.
Non-Discrimination
Workers should not receive the harassment or illegal discrimination. They should not
be discriminated without reasonable
reasons based on the race, color, age, gender,
sexual orientation, ethnicity, disability, pregnancy, religion, political affiliation,
union status, marital status in the employment practices such as hiring andpromotion, compensation, and training opportunities. Besides the
exceptional cases according to the local laws and regulations or required for workplace safety, the company
should not conduct medical examinations or
unlawfully using their results for the purpose of discrimination.
■ Health and Safety
It
should be recognized that the activities to
ensure the safety and health of
workers is essential in all
activities conducted in company works such as the production of the product. Depending on local laws and regulations the efforts to build and maintain a safe and healthy workplace should be made.
Industrial
Safety
In order to control the exposure of the workers to potential safety hazards(eg, electrical shock, fire,
vehicles, and fall hazards, etc.) the properdesign, engineering and administrative
controls, preventative maintenancelevel, safe work
procedures (lock, protective devices) should be
built and at the same time continuous safety
training must be conducted. If
the risk factors cannot adequately be controlled
through the above mentioned means, then appropriate personal protective
equipment must be provided to the workers. It should be
ensured that the workers areable to freely raise the issues concerning
safety to management.
Emergency
Preparedness
Potentially possible emergencies and accidents must be identified and assessed in advance. Reports, announcements
to the workers and evacuation procedures would be made, and emergency plans and response procedures including ensuring emergency evacuation drills targeted workers, escape facilities, fire detection and suppression
equipment, the recovery plan should be established and
implemented to minimize the damage caused by the
emergency and accidents.
Occupational
accidents and diseases prevention
The systems and procedures to prevent,manage, track and report the workers' industrial
accidents and disease should be built. This systems and
procedures should include the provisions as follows: A) to encourage employees to report freely,
B) to classify and record occupational accidents and diseases, C) to provide the necessary medical
treatment, D) to investigate the cause of each case and implement the corrective action to remove it, and by these E) to support the employee's return who left the work due to the industrial accident and disease.
Hazards
Exposure Reduction
The exposure of the workers to the chemicals used in the workplace, biological factors, such as pathogens, viruses, and physical factors including high
temperature and radiation should be identified, evaluated, and
controlled. The problem on the health and safety of workers due to the above mentioned harmful factors should be avoided
through the technical controls such as the calibration and improvement of the production facility and the
administrative control according to the legal and institutional requirements. If the risk factors cannot be adequately controlled by these means, then the health of workers should be protected
through appropriate personal protective equipment provision
and the program operation.
The works
with physical burden
Workers’ exposure
to physically demanding tasks,
including repeated manual jobs or standing for a long time, lifting heavy
things, and assembly work requiring a lot of physical strength consumption should be identified, evaluated and controlled.
Dangerous machinery, equipment and facility safety management
In using machinery, equipment and
facilities needed for the production their safety
should be assessed. In case of using the machine through which the workers are
exposed to the danger, physical protection devices, interlocks,
and barriers must be provided and properly
maintained.
Providing
dormitory and sanitation facility
Clean toilet and potable
water facilities should be provided to the workers with the space to cook and store food hygienically, and the place for eating a
meal. The dormitory offered to employeesmust be clean, safe, and provided with appropriateemergency evacuation facilities,
heating and ventilation, a reasonablelevel of access rights,
and appropriate personal space.
■ Environmentally friendly
management
Environmental
pollutants generated by business
operations must be thoroughlymanaged. The environmental impact that
occurs when providing the product and service
should fully understood and the efforts to reduce them should be made. Environmental
laws and regulations related to the management and disposal, recycling of chemicals and waste, industrial water management and reuse, greenhouse
gas and atmospheric emissions must be observed. If the environmental
standards required for the design and production of the
products is needed in other contracts, they should be observed, too.
Acquiring
environmental certifications and licenses
All environmental certifications and licenses necessary for the business
operations (eg, air emissionfacilities, etc.) and registrations should acquired,
maintained, and managed, and the recent amendmentsshould be reflected to them. And the requirements necessary for getting licenses and certifications
such as managing and reporting must be complied.
Pollution
prevention and resource use reduction
The company should try to reduce or eliminate all forms of waste, including waste water according
to local laws and regulations through the methods such as production process improvement,
maintenance enhancement, plant process changes, raw materialsubstitution, recycling and reuse of materials.
Management of Hazardous Substances
In the case of the discharge of hazardous substances chemicalsand other substances with the possibility
of environmental pollution should be identified, and must be treated
safe, moved, stored, used, reused and recycled, and disposed. The local laws and regulations prohibiting or regulating the use and
treatment of certain substances should be observed.
Wastewater
and solid waste
Wastewater sewage
and solid waste arising from industrial
processes and sanitation facilities in the process of
the business operation should be emitted according to applicable
laws and regulations, or
before their disposal the
properties of those materials should be identified and monitored, and then they
should be appropriately treated and controlled.
Air
Pollutants
The properties of volatile organic
chemicals, aerosols, corrosives,fine powder, ozone depleting substances,
greenhouse gases and combustion by-products generated in the process, before their emissions to the air, should be
identified and monitored, and then they should be appropriately treated and controlled
according to local laws and regulations.
The observance
of substances regulations in products
The local laws and
regulations associated with the use prohibition or restriction of certain
substances including indicating the information about the materials at
the time of recycling and disposal of the materials, and the requirement of the
related agency should be observed. In addition, hazardous
chemicals management guideline 「EI-4463」 must be observed.
■ Ethical management
Management activities of the business operationsshould be complied with all local lawsand regulations, and are required to
maintain the highest ethical standards.
Clean
organizational culture
In relation to any corporate transaction the highest level of integrity is required. A zero
tolerance policy related with anti-corruption should be
established which prohibits the any form of action to give or receive bribe
contrary to the local regulations and laws for the purpose of influencingthe decision-making process, corruption, forcing and embezzlement (including the
case when bribery is promised, provided, granted or tolerated), rebates, etc. The
appropriate level of monitoring and enforcement
procedures must be executed to evaluate the compliance
with anti-corruption laws and
regulations.
Information
Disclosure
According to the relevant
laws and regulations, and general industry practice management activities,organizational structure, financial
condition and performance information should be accurately recorded and the information must be disclosed.
Intellectual
property protection
Intellectual property rights must be respected. The transfer of technology and know-how is must be done in a way protecting intellectual property rights.
Fair
trade, advertising and competition
The standard of fair trade, advertising, sales, and competition
must be observed.
Identity
Protection
According to thelaws and regulations relevant with identity
protection the program for the whistleblowerprotection and ensuring his confidentiality
should be introduced and maintained. According to relevant laws and regulations the process
through which the workers may raise issuesor exchange ideas without fear of retaliation should be built.
